The member of the High National Commission for Appeals Related to Investment, Kamel Kheffache, insisted, the day before yesterday Monday in Algiers, on the obligation to file appeals relating to the granting of economic land at the level of the Agency Algerian Investment Promotion Authority (AAPI), before resorting to the commission in the event of an unfavorable opinion.
On the sidelines of his participation in the Forum of the daily newspaper ”El Moudjahid” which received the Director General of the AAPI, Omar Rekkache, Mr. Kheffache underlined that the investors having not obtained economic land, after the expiration of the deadline legal of land base offers on the investor’s digital platform, were required to comply with appeal procedures involving “the prior filing of a request with the AAPI, which must decide within a maximum period of 15 days from the date of receipt. If the request is admissible, the final decision of the AAPI will be notified to the person concerned with the cancellation of the provisional decision previously issued. If the request is refused, the investor may file an appeal with the High National Commission for Appeals Related to Investment, attaching all supporting documents including the refusal of the AAPI. The commission must decide within one (01) month from the date of referral.
For his part, the CEO of the AAPI affirmed that the failure to obtain economic land by the applicant did not mean a “refusal”, but that he, rather, obtained the lowest score according to the grid. evaluation of the projects in force, specifying that “their request will be examined in the event of cancellation of the project which benefited from the decision or non-compliance of the beneficiary’s information appearing in the declaration when submitting their request via the platform -digital form”. Note that the High National Commission for Appeals Related to Investment was created under Law No. 22-18 of July 24, 2022 on investment. The Presidential Decree of September 2022 established the composition of the commission and its functioning as a “High authority responsible for ruling on appeals brought by investors who consider themselves wronged under the application of the provisions of the law on investment”.
